SUBJECT

- These General Terms and Conditions govern the relationship between "Consult-Lozanov" EOOD (www.instrumentipro.bg) and all users of the Electronics Store located on the domain www.instrumentipro.bg, its subdomains and our Facebook page.

- These include terms of use, cookies, registration and delivery rules, voluntary dispute resolution, contract cancellation and exchange forms and any other legally relevant information found on the Site.

- The general conditions can be changed unilaterally by "Consult-Lozanov" EOOD (www.instrumentipro.bg) at any time. These changes are effective immediately and are binding on all customers and users. Any changes will be announced and posted promptly with the Site.

TERMINOLOGY

- Customer / User : Any person or entity who uses the Site in any way, including by browsing it and or purchasing a product by ordering from the Site.

- Merchant / Seller : Consult-Lozanov Ltd.

- Account / Profile : A section of the Site formed by an email address and password that allows the Customer to use the services of the Site, in cases where an account is required to use them.

- Site : The e-store located at the domain www.instrumentipro.bg , its subdomains and our Facebook page.

- Personal Data : Information about an individual (first and last name, home address, email address, telephone number, Internet Protocol (IP) address, cookie ID).

- Order : An order made by a User through the Online Store for the purchase of one or more specific goods (items). 

   The Order is considered Accepted only when there is an electronic confirmation (e-mail) sent by InstrumentiPro.bg to the Customer, without requiring confirmation of receipt by the Customer.
   The order is considered Confirmed only when there is an electronic confirmation (e-mail) sent by InstrumentiPro.bg to the customer.
   InstrumentiPro.bg is not responsible if the customer does not receive a confirmation e-mail due to a wrong e-mail address provided by the customer, or due to a reason attributable to the electronic system where the customer's mail is registered.

- Goods : One or more items offered through the Online Shop, the characteristics, price and delivery conditions of which are indicated on the website.

- E-shop : The website www.instrumentipro.bg, which serves as a virtual platform for ordering and buying a specific good (item) remotely.

- Courier : A merchant who physically delivers the purchased goods to an address specified by the User and operates under the requirements of the Postal Services Act.

- Purchase Contract : Represents the contract concluded remotely through the e-store, between the seller and the customer, without the physical presence of the seller and the customer. Under this contract, the seller transfers or undertakes to transfer the ownership of one or more specific goods to the consumer and the consumer pays or undertakes to pay the price for them. At no time does an unconfirmed order have the force of a contract of sale.

DELIVERY ISSUES

- The execution of your order may be hindered for any of the following reasons:
 No payment (delay in payment) has been made by the user if he has opted for a bank transfer.
    The user has provided incorrect or incomplete details and delivery address.
    No telephone number to contact the consumer.
- In this case, the Merchant is not bound by any obligation to fulfil the order.

- In the event that the product selected by the customer cannot be delivered due to out of stock, the customer will be informed and warned that their order cannot be Confirmed and the product will not be dispatched.

- The Website contains a large number of goods and it is possible that, despite our best efforts, some of the characteristics of the goods listed on the Website may be incorrect. If we discover an error in the price of goods you have ordered, we will inform you as soon as possible and give you the opportunity to confirm your order at the correct price or cancel it.
- In some cases, the colour of the items ordered may differ from those pictured on the Site. The color of the item does not affect its quality parameters.

USER AND CUSTOMER RIGHTS AND OBLIGATIONS

- The customer has the opportunity to view and /after registration/ to order the announced goods on instrumentipro.bg
- The customer has the right to be informed about the status of his order.
- The customer is fully responsible for the protection of his username and password, as well as for all actions performed by him or a third party using the username and password. The User is obliged to immediately notify the Merchant of any case of unauthorized access using his username and password, as well as whenever there is a risk of such use.
- The user is obliged to pay the price of his order according to the method announced on the instrumentipro.bg page
- Every user, regardless of whether he is a client of the Merchant, undertakes when using the services:
• not to violate and respect the fundamental rights and freedoms of citizens and human rights, according to the Constitution and laws of the Republic of Bulgaria and recognized international acts;
• not to harm the good name of another and not to call for a violent change of the constitutionally established order, to commit a crime, to violence against the person or to incite racial, national, ethnic or religious enmity;
• not to violate someone else's property or non-property, absolute or relative rights and interests, such as property rights, intellectual property rights, etc.;
• to comply with Bulgarian legislation, applicable foreign laws, rules of morality and good manners and Internet ethics when using the services provided by www.instrumentipro.bg ;
• to immediately notify the Merchant of any case of a committed or discovered violation when using the provided services;
• not to upload, send, transmit, distribute or use in any way and not to make available to third parties software, computer programs, files, applications or other materials containing computer viruses, unauthorized remote control systems ("Trojan horses”), computer codes, or materials designed to interrupt, impede, disrupt or limit the normal operation of computer hardware or software or telecommunications facilities or intended to unauthorized intrusion or access to foreign resources or software;
• not to commit malicious acts;
• to indemnify the Merchant and all third parties for all damages suffered and lost benefits, including for any costs and attorneys' fees paid, incurred as a result of claims brought by and/or compensation paid to third parties in connection with Internet pages, hyperlinks, materials or information that the User has used, placed on the server, sent, distributed, disclosed to third parties or made available in violation of the law, these General Terms and Conditions, Good manners or Internet ethics;
- The customer undertakes to indicate an accurate and valid telephone number, delivery address and email address, to pay the price of the goods, to pay the costs of delivery when the same is not free and to ensure access and the possibility of receiving the goods. In the event that it is not explicitly stated that the delivery is free, it is considered paid.

RIGHTS AND OBLIGATIONS OF THE MERCHANT

- The merchant does not have the obligation and the objective opportunity to control the way users use the services provided.
- The merchant has the right, but not the obligation, to save materials and information located on the server of instrumentipro.bg
- The Merchant has the right at any time, without notification to the User/client, when the latter uses the services in violation of these conditions, as well as at the discretion of the Merchant to terminate, stop or change the services provided in connection with the use of the site. The trader is not responsible towards users and third parties for damages suffered and lost benefits, which occurred as a result of the termination, suspension, change or limitation of services, deletion, modification, loss, unreliability, inaccuracy or incompleteness of messages, materials or information transmitted, used , recorded or made available through instrumentipro.bg.
- The trader, after receiving the payment, undertakes to transfer to the user/customer the ownership of the goods requested for purchase by him, to deliver the goods requested for purchase on time, to check the technical condition of each item before it is sent (in case this is possible without breaking the integrity of the package).
- The merchant is not responsible for damages caused to software, hardware or telecommunications equipment, or for loss of data resulting from materials or resources searched, loaded or used in any way through the services provided. The advice, consultations or assistance provided by the specialists and employees of the Merchant in connection with the use of the services by the users does not give rise to any

PROTECTION OF PERSONAL DATA

- Konult-Lozanov EOOD undertakes to guarantee to its users/clients the confidentiality of the provided information and personal data that you provide on the company's website.
- Registration of a user profile on the site is not mandatory.
- To use the benefits of a user profile on the site, you must first register one. With it, you will get the opportunity to more easily make requests to purchase the goods offered on the site, review the history of past orders, leave comments on the site, take advantage of special promotional offers, etc.
- When registering, you must enter correct personal data: the address that will be used for delivery, your first and last name, e-mail, contact phone number. You also need to choose a password.
- Users who have completed the registration form on the site expressly agree to the personal data provided by them being processed by instrumentipro.bg electronically upon delivery of ordered goods.
- We will provide minimal personal data (names, address, contact phone number) to a courier company for distance sales
- When registering on the site and placing an order, your data will be stored on the server of: SUPERHOSTING.BG EOOD
- The connection between your computer and the server is guaranteed by a security certificate, which is an additional guarantee and protection of the personal data you provide.
- Your personal data will be used and stored solely for the purpose of serving users - acceptance and execution of orders, for the purposes of Bulgarian and European legislation in compliance with all statutory provisions and will enjoy the highest level of protection.
- At any time, you have the right with a written application to request and receive information about which of your data are stored and processed, to request a correction of the processed personal data, to withdraw your consent to the storage and processing of personal data (to be deleted), with the exception of cases where their processing and storage by the administrator is an obligation by law (for example, the Accounting Act).
- The site allows you to subscribe and receive notifications about new or updated products to your email address. Users subscribed to our newsletter can unsubscribe at any time.
- Personal data is stored for as long as necessary for the purposes, insofar as we are legally obliged to store it or other legal reasons justify further processing.
- Instrumentipro.bg does not collect or process personal data of persons under the age of 18, and in the event that we detect the provision of such data, we will destroy this data according to our company's internal rules and refuse to fulfill the relevant order.
- The site guarantees that the data in question will not be provided in any form to third parties or used for purposes other than those described above, except in the cases provided for in the current legislation.
- Personal data privacy policy complies with the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons in connection with the processing of personal data and on the free movement of such data and for the repeal of Directive 95/46/EC (GDPR).

These files make it possible to use instrumentipro.bg as well as allow us to prepare anonymous statistics that help us understand how users use our websites and thus improve the service we provide.

PRICES

- All prices listed on the Site are in euros and include VAT.
- The prices quoted on the Site do not include the cost of delivery to the address specified by the Customer, which are at the expense of the Buyer.
- In the event that the goods are shipped outside the territory of the Republic of Bulgaria, the user/customer must pay all customs and other fees associated with the export.
- The delivery price generated after ordering may be different from the actual delivery price, as the price is automatically calculated taking into account the weight of the products without the transport packaging.

INTELLECTUAL PROPERTY

- All content present on the Site is the property of "Consult-Lozanov" EOOD.
- Copying content from the Site, placing it on other websites and online stores is prohibited.
- Users can use the content of the site only for the purposes of buying and selling.

DELIVERY

- The delivery of the ordered products is carried out by the courier company Econt, and the user chooses whether the shipment is to a specified address or to the courier's office.
- Delivery of the ordered goods is at the expense of the User. 

- The delivery is inclusive of the Preview service and SMS notification service. You must pay for the delivery before viewing the contents of the shipment. 
- Upon acceptance of delivery by the Customer without remark, any and all subsequent claims for external visible defects of the goods received shall be deemed to be unfounded and as such will not be satisfied.
- In the event that you do not like the product you have received, you will have to pay the courier services for the return of the parcel.

- In the case of returned orders due to the absence of the recipient, the shipping cost will be charged on the next order. 
 Instrumentipro.bg reserves the right to claim the amount of shipping and return of the goods to be refunded by the Customer.

- For products incorrectly ordered by the Customer, the return transport and subsequent delivery of the replacement product shall be borne by the Customer.

- In case of a factory defect found by InstrumentiPro employees, the courier costs shall be borne by the Merchant.

- Ordered products are delivered on the next working day after the order has been processed.
  For combined orders of the Hardy brand and another manufacturer, requested products are delivered within one to three business days after the order is processed. 
  For locations without an office, the delivery time depends on the service schedule of the location according to the estimate of the courier company Econt.

- Saturday deliveries are made until 3 p.m. with an automatic ‘Saturday Delivery’ service fee added (which is payable separately from the final amount advertised on the website) and only in cities where there are Econt offices. If you would like the parcel to be delivered on a weekday, please note this in the comments box when completing your order.
 
- Orders placed after 16:30 are processed the next working day. Orders placed on Saturdays, Sundays, public holidays, non-working days and declared company holidays are processed on the next official working day.
- Orders for all Hardy branded products placed after 12:00pm are processed on the next official business day. Orders placed on Saturdays, Sundays, public holidays, non-working days and declared company holidays are processed on the next official working day.

- In all cases, there may be a delay in the stated delivery times, for which you will be promptly notified and asked to agree to said delay and confirm the order accordingly. 

- In the event of circumstances preventing the timely execution of the delivery, Instrumentipro.bg undertakes to notify the User within three days by sending a message to the e-mail address provided by the Customer or to the telephone number indicated.
- We shall not be held liable for any delay in case it is due to the courier.

- The Merchant reserves the right to refuse delivery of a confirmed order if the goods are not available. 
- In the event that the product cannot be delivered, the Merchant may offer an alternative product with similar characteristics and price, which the customer has the right to accept or refuse. In the event that a credit is made to the Merchant's account, the customer will be able to choose between a refund, cancellation or replacement order.

PAYMENT

- Orders from the site can be paid in the following ways:
   - cash on delivery : in this case, the Customer is obliged to pay the courier the value of the ordered and delivered goods, including the cost of delivery, SMS notification service, as well as a fee for the cash on delivery, which depends only on the price of the ordered products.
   - by bank transfer : in this case the Customer undertakes to pay to the Seller's bank account the value of the goods ordered, including the cost of delivery, SMS notification service. The delivery period starts from the moment the amount of the order is credited to our bank account.
   - via a virtual POS terminal : in this case, the Customer undertakes to pay via the POS terminal indicated on the Site the value of the goods ordered, including the cost of delivery, SMS notification service.

- The cost of delivery, SMS notification service, as well as the cash on delivery fee (in case of cash on delivery) are included in the final price upon completion of the order.

- The Seller will invoice the customer for the goods ordered and delivered based on the information provided by the customer. Where the latter has not indicated that he wishes an invoice, only a fiscal document for the sale shall be provided upon receipt of payment.
- Econt shall issue a receipt on behalf of InstrumentiPro. Use the receipt in question as proof of payment for the goods you have purchased.

- We offer the purchase of goods on deferred payment. Contact us for more information on installment purchase terms.

- Different types of discounts cannot be combined when ordering and purchasing the same product.

- General Terms and Conditions for using DSK's V-POS terminal

1. Payment by debit/credit card via V-pos.
2. Types of cards accepted: debit, credit and business cards Visa, Mastercard, Bcard
3. Transactions are carried out using the MasterCard Identity check and VISA Secure security programs.
4. From the point of view of security, the maximum amount for card payment is 2,500 euro.
5. We do not store data about the bank cards used for payment through the site.
6. If it is necessary to return an amount paid with a bank card, the amount is refunded to the card with which the payment was made.

ORDER CANCELLATION AND RETURN OF GOODS

- Every user has the right to refuse the goods purchased by him within 14 days from the date of receipt, without owing compensation or a penalty and without stating a reason for the return.
- The user is obliged to store the received goods, its quality and safety until the moment of its return to instrumentipro.bg. The returned item must be in the same condition as it was received, in its original packaging, unused and undamaged (eg torn packaging, labels removed, missing parts, etc.) and accompanied by all accompanying documents - receipt and/or invoice, warranty card, instructions for use, etc.
- Products that have undergone unauthorized interventions, those that show signs of wear or use, scratches, peels, mechanical/electric shocks, products without accessories are not accepted.
- The merchant has the right not to refund the amount paid if the product does not meet the conditions for return. The customer will be notified that he loses his right of withdrawal.
- Transport costs for returning the goods are at the customer's expense.
- The consumer must send the goods back to the trader within 14 days from the date on which the consumer informed the trader of his decision to cancel. The user will have to pay the costs of returning the goods.
- instrumentipro.bg refunds the amount received by the user within 14 days from the date on which the user exercised his right of withdrawal.
- If the returned products were accompanied by gifts, they must also be returned.

WARRANTY TERMS AND COMPLAINTS

- All products come with a legal warranty of 24 months from delivery of the goods for individuals and a commercial warranty of 6 months from delivery of the goods for legal entities.
- A claim must not be made later than 2 months from the discovery of the damage due to a manufacturing defect.
- The warranty is only valid for damage due to a manufacturing defect that has occurred within the warranty period.  
If the claim is justified, the trader will remedy the defects at his own expense. The amount paid will be refunded if the goods cannot be repaired or replaced within one month.
- Warranty is valid only if the goods are used properly, in accordance with their technical characteristics.
- Use of the products for other than their intended purpose, incompetent repair or alteration will automatically result in loss of warranty rights.
- The warranty provided for the product does not cover product components with a limited shelf life (batteries, consumables, etc.).
- Goods under warranty must be returned in their original packaging with a sticker and serial number identifying them, together with their accessories, for possible replacement. We ask that goods sent under warranty be properly packed, as we do not accept responsibility for damage received during transit. We will examine the goods handed over and the nature and cause of the damage will be established and whether or not the claim made is justified. The customer will be promptly notified of the finding within 10 days.

- The characteristics, descriptions, pictures and prices of the products on the e-shop may be changed at any time.
- Although InstrumentiPro.bg strives to provide the most complete and real information about each product in order to provide quality service to consumers, sometimes, due to technical or other reasons, it is possible that the characteristics, descriptions, photos and prices of products contain errors, for which InstrumentiPro.bg apologizes in advance to its customers. InstrumentiPro.bg is not responsible for such discrepancies and the customer has no right to hold the seller liable for them.

- Complaints can be made in free text to support@instrumentipro.bg
- Instrumentipro.bg maintains a register of claims.

- In the event of an Invalid Claim, all transport and service costs shall be borne by the Customer.

- The claim must be accompanied by an invoice/receipt evidencing payment. We are under no obligation to honour claims which do not contain any of the above documents.

- Claims for incompleteness of the product shall only be honoured at the time of purchase.

- The trader shall not be liable for damages of any nature, loss of profit or consequential loss or damage due to a defective product.

- All disputes between the parties shall be resolved amicably and in good faith. In the event that no agreement is reached, all unresolved disputes, including disputes arising out of or relating to the interpretation, invalidity, performance or termination thereof, as well as disputes concerning the filling of gaps in the contract or its adaptation to newly arising circumstances, shall be resolved by the competent court of registration of the trader in accordance with Bulgarian law.

RULES AND CONDITIONS FOR USE OF PROMOTIONAL CODES AND VOUCHERS

- The code or voucher entitles you to purchase regular price products from the product range.
- The customer is entitled to a single use of the discount code.
- Discount codes are not combinable with other available special offers and cannot be used on Permanently Low Priced products.
- Discount codes are not cumulative.
- Discount codes cannot be exchanged for cash equivalent.
- Discount Codes are not a method of payment as they are only fixed amount or percentage discounts provided by the owner of the InstrumentiPro.bg online store. The customer activates the code by adding a selected item to the shopping cart and entering the discount code.
- Discount codes and vouchers have specific validity periods, which the partner informs about. After the expiry date, the discount codes and vouchers will not be available.
- Discount codes may be of limited use for certain brands and/or categories, according to the terms of the specific promotional offer.
- Goods purchased under the promotional offer may be returned in accordance with the rules set by the store.
- In case of return of goods purchased within the promotional offer, the Customer shall receive back the value of the product indicated in the receipt.

HOW TO ORDER

- Registration is free and optional.

- To order a product you need to click the ‘Add to cart or ‘Quick Order’ button (select a size if available).

- To order more than one of a product, use the arrows.

- To view the products in your cart, press the ‘View cart’ button. Here you can change the number of products (use the arrows) or remove a product (press X).

- If you wish to add more products, press the ‘Continue shopping’ button.

- To complete your order, press the ‘Checkout’ button. Here you can also change the number of products (set the desired number) or remove a product (press the checkout key). The price of each individual product as well as the final price including shipping is listed in this section.

   Fill in the required data:
    * First name, last name, phone , email, shipping address.
    * Invoice details if you would like one.
    * Delivery address

   Select payment method:
    * Cash on delivery (you pay the order to the courier at the time of receipt).
    * By bank card (you fill in your card details).

   Write down further clarifications about the order if you have any.

   Fill in your voucher number if you have one.

   Fill in your coupon number (discount code), if you have one.

   Check that you declare that you are aware of the information about the processing of your personal data, as well as your rights as stated in the terms and conditions.

   Click the ‘Confirm the order’ button. If any of the required fields is not filled in, a caution message will be displayed in red next to the field in question.

- Your order is complete when ‘Your order has been successfully processed!’ is displayed.

- You will receive an automated message to the email you provided with a full description and your individual order number.

- To cancel your order contact us to suspend the order.

- When your order has been dispatched, you will receive an automatic message to the email you have provided with a link to your order and your Econt consignment number.
